WHEREAS, beach fires are permitted pursuant to certain guidelines set forth in the Town Code at Chapter 141 "Fire Prevention" which were adopted for the purpose of assuring the safety of the public during and after a beach fire; and

WHEREAS, the Town Board believes that containing beach fires within a metal container will help facilitate the clean-up of the fire site and prevent injuries; and

WHEREAS, the Town Board is considering amendment to Chapter 141 "Fire Prevention" Article III "Open Burning, Outdoor Fires and Beach Fires" to provide for beach fires to be fully contained within a metal container; said local law to read as follows:

INTRODUCTORY NO. 30 OF 2015


A Local Law providing for the amendment of Chapter 141 ("Fire Prevention"), Article III Open Burning, Outdoor Fires and Beach Fires, Section 141-19 "Beach Fire Regulations" Paragraph "A" of the East Hampton Town Code to add a provision to require beach fires to be contained in a metal container, all as more fully set forth in the text of the Local Law, said Local Law to read as follows:


BE IT ENACTED by the Town Board of the Town of East Hampton as follows:


SECTION I. - FINDINGS AND OBJECTIVES:


The presence of debris left behind from beach fires, including but not limited to items such as nails, wire, broken glass and hot smoldering coals creates a safety hazard to those individuals using the beach following a beach fire. Requiring fires to be fully contained within a metal container will enable those utilizing such fires to better comply with existing regulations which require the fire to be properly and completely extinguished and the debris properly and completely disposed of to restore the site to its natural condition.


SECTION II. - TOWN CODE AMENDED:


Chapter 141 "Fire Prevention" Article III "Open Burning, Outdoor Fires and Beach Fires", Section 141-19 "Beach Fire Regulations" Paragraph "A" is hereby amended to add the following:

11. All beach fires must be fully contained within a metal container.


SECTION III. - EFFECTIVE DATE:

This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

RESOLVED, that the Town Clerk is hereby directed to publish the following Notice of Public Hearing in the July 23, 2015 edition of the EAST HAMPTON STAR:


NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Town Board of the Town of East Hampton will hold a public hearing at Town Hall, 159 Pantigo Road, East Hampton, New York, on Thursday, August 6, 2015, at 6:30 p.m., or as soon thereafter as this matter may be heard, to consider comments of all persons regarding the amendment of Chapter 141 "Fire Prevention" of the East Hampton Town Code for purposes of protecting the safety of the public utilizing beaches during and after a beach fire, an abstract of which is as follows:

A local law to amend Chapter 141 "Fire Prevention", Article III "Open Burning, Outdoor Fires and Beach Fires", Section 141-19 "Beach Fire Regulations" Paragraph "A" to add the following requirement:

11. All beach fires must be fully contained within a metal container.

The full text of the proposed local law is available in the Town Clerk's office for inspection. Any person who wishes to be heard with regard to the proposed local law may appear in person or by agent at the time of the hearing or by correspondence addressed to the East Hampton Town Board, c/o Town Clerk, 159 Pantigo Road, East Hampton, New York 11937, said correspondence to be received before the date and time of the hearing
