Schedule Public Hearinng - Amendment of Chapter 240-75: Parking Prohibited on Leeton Road

 

WHEREAS, the Town Board desires to amend Chapter 240 (Vehicles and Traffic), Section 240-75, Schedule XXV "Parking Prohibited May 15 Through October 1" of the East Hampton Town Code in order to extend the current regulation to include a section of Leeton Road between Marlin Drive and Atlantic Drive that was inadvertently omitted from the initial legislation; now therefore, be it

 

              RESOLVED, that the Town Clerk is hereby directed to publish the following Notice of Public Hearing in the June 14th edition of the EAST HAMPTON STAR:

 

NOTICE OF PUBLIC HEARING

 

              TAKE NOTICE that the Town Board of the Town of East Hampton will hold a public hearing on Thursday, June 21, 2018 at 10:30 a.m. in the main meeting room, Town Hall, 159 Pantigo Road, East Hampton, New York, or as soon thereafter as this matter may be heard, to consider the amendment of Chapter 240 (Vehicles and Traffic), Section 240-75, Schedule XXV "Parking Prohibited May 15 Through October 1" of the East Hampton Town Code in order to further regulate parking on Leeton Road, Amagansett.

 

              Any person wishing to be heard with respect to the foregoing may appear in person or by counsel at the time of hearing, or may submit written comment to the Town Clerk prior to the same.

 

BE IT ENACTED by the Town Board of the Town of East Hampton as follows:

 

Section 1.  Town Code Amended.

 

Chapter 240 (Vehicles and Traffic)

 

Section 240-75. Schedule XXV: "Parking Prohibited May 15 Through October 1" is hereby amended to add the following:

Section 2. - SEVERABILITY:

 

              Should any part or provision of this Local Law be decided by the courts to be unconstitutional or invalid, such decision shall not affect the validity of this Local Law as a whole nor any part thereof other than the part so decided to be unconstitutional or invalid.

                                         

Section 3.  Effective Date.

 

              This local law shall take effect immediately upon filing with the Secretary of State as provided for by law.

Professional Services - Energize East Hampton Campaign Logo Design

 

WHEREAS, the Town of East Hampton received the New York State Energy Research and Development Authority (NYSERDA) Community Solar NY Grant, and the Town's Department of Natural Resources started a "Solarize South Fork" campaign labeled "Energize East Hampton"; and

 

WHEREAS, the NYSERDA grant was received for the promotion of solar energy in the amount of $5,000 and the Town wishes to use the grant for various visual and web based promotions of the use of solar energy; and

 

WHEREAS, the Natural Resources Department wishes to hire Studio 8 Inc. to re-design and conceptualize the Energize East Hampton logo for further promotion of the program; now, therefore, be it

 

RESOLVED, that Studio 8 Inc., is hereby retained to provide professional graphic design services as set forth in their proposal of May 16, 2018, and the Supervisor is hereby authorized to enter into an agreement with Studio 8 Inc. for the same; and be it further

 

RESOLVED, that Studio 8 Inc. shall be paid at the rate of $65/hr. for graphic designer, with a total budget not to exceed $1,885.75 to be paid from Budget Account #A8790-54528.

Approving Water Improvement Within the Wainscott Water Supply Area

 

RESOLUTION OF THE TOWN OF EAST HAMPTON, NEW YORK, ADOPTED JUNE 5, 2018, APPROVING THE CONSTRUCTION OF A WATER IMPROVEMENT WITHIN THE WAINSCOTT WATER SUPPLY AREA, AN AREA OF THE TOWN OUTSIDE OF ANY VILLAGES, WHICH HAS BEEN DETERMINED TO BE THE BENEFITED AREA, AND MAKING OTHER DETERMINATIONS IN CONNECTION THEREWITH

Recitals

WHEREAS, the Town Board of the Town of East Hampton (herein called “Town Board” and “Town,” respectively), in the County of Suffolk, New York, has caused the Suffolk County Water Authority and their engineers, duly licensed by the State of New York, to prepare a general map, plan and report for the proposed construction of water improvements within an unincorporated area of the Town hereinafter described, consisting of the construction and installation of approximately 45,000 feet of water mains, including, as an where required, buildings, land or rights in land, original furnishings, equipment, and machinery and apparatus required in connection therewith, all as described in the map, plan and report prepared for the Town by the Suffolk County Water Authority, dated May, 2018 (the “Water Improvement”); all within an unincorporated area of the Town outside of any villages, which area has been determined to be the benefited area (the “Wainscott Water Supply Area”), pursuant to Article 12-C of the Town Law, which map, plan and report have been heretofore duly filed in the office of the Town Clerk for public examination; and

WHEREAS, the Suffolk County Water Authority, acting as Lead Agency for the Water Improvement, has heretofore made appropriate and necessary findings pursuant to the New York State Environmental Quality Review Act (SEQRA), constituting Article 8 of the Environmental Conservation Law and 6 N.Y.C.R.R., Regulations Part 617.5, and determined that no substantial adverse environmental impact will be caused by the Water Improvement, and the Suffolk County Water Authority adopted a Negative Declaration pursuant to SEQRA; and

WHEREAS, after giving due consideration to the findings and determinations of the Suffolk County Water Authority regarding the impact that the Water Improvement may have on the environment and, on the basis of such consideration, the Town Board found that no substantial adverse environmental impact will be caused thereby, and the Negative Declaration adopted by the Suffolk County Water Authority was filed in the office of the Town Clerk; and

WHEREAS, the maximum amount proposed to be expended for the construction of the Water Improvement is estimated to be $24,344,878, which is proposed to be financed by the issuance of bonds of the Town; and

WHEREAS, the costs of the Water Improvement, including payment of principal of and interest on said bonds as the same shall become payable, shall be borne partly by the area of the Town outside of any village and partly by the Wainscott Water Supply Area; and

WHEREAS, such costs to be borne by the area of the Town outside of any village shall be paid by the assessment, levy and collection of assessments from the several lots and parcels of land in said area in annual installments in the same manner as other Town charges, and such costs to be borne by the lands benefited thereby shall be paid by assessment, levy and collection of assessments from the several lots and parcels of land within the Wainscott Water Supply Area which the Town Board shall determine to be especially benefited by the Water Improvement, so much upon and from each as shall be in just proportion to the amount of benefit which the Water Improvement shall confer upon the same, to pay the principal of and interest on said bonds as the same shall become due and payable; and

WHEREAS, any funds received from the United States of America and/or the State of New York in relation to the Water Improvement shall be applied towards the cost of construction of the Water Improvement or payment of the principal and/or the interest on the Town’s obligations issued therefor, or will be budgeted as an offset to the taxes for the payment of the principal and interest on said obligations; and

WHEREAS, the annual cost of operation and maintenance of said Water Improvement shall be paid by a charge upon the entire area of the Town outside of any villages and shall be levied and collected in the same manner and at the same time as other Town charges;

WHEREAS, the Town Board determined to proceed with the construction of such Water Improvement and adopted an order on May 8, 2018, reciting a description of the improvements proposed, a description of the proposed benefited area, the maximum amount to be expended, the proposed method of financing to be employed, the fact that map, plan and report describing the same are on file in the Town Clerk’s Office for public inspection and specifying May 21, 2018 at 6:30 P.M. (Prevailing Time) as the time when, and the Town Hall, in the Town, as the place where, the Town Board would meet to consider the construction of such Water Improvement and to hear all persons interested in the subject thereof concerning the same, and for such other action on the part of the Town in relation thereto as may be required by law; and

WHEREAS, certified copies of such order were duly published and posted pursuant to the provisions of Article 12-C of the Town Law; and

WHEREAS, a public hearing in the matter of the construction of the proposed Water Improvement was duly held by the Town Board on May 21, 2018, commencing at 6:30 P.M. (Prevailing Time) at the Town Hall, in the Town, at which all interested persons desiring to be heard were heard, including those in favor of, and those opposed to, the construction of said Water Improvement;

Now, therefore, upon the evidence adduced at such public hearing, be it

RESOLVED BY THE TOWN BOARD OF THE TOWN OF EAST HAMPTON, IN THE COUNTY OF SUFFOLK, NEW YORK, AS FOLLOWS:

Section 1.              The Town Board of the Town of East Hampton (herein called “Town Board” and “Town,” respectively), in the County of Suffolk, New York, hereby determines that:

(a)  the notice of public hearing was published and posted as required by law, and is otherwise sufficient;

(b)  it is in the public interest to construct the Water Improvement, described in the Recitals hereto, within the Wainscott Water Supply Area, at the estimated maximum cost of $24,344,878; and

(c)  all the property in the proposed Wainscott Water Supply Area is benefited by the Water Improvement and all the property benefited by the Water Improvement is included in the proposed Wainscott Water Supply Area.

Section 2.  The construction of the Water Improvement within the Wainscott Water Supply Area, as described in the Recitals hereto, is hereby approved and such improvement is hereby authorized to be constructed, within the Wainscott Water Supply Area, in the Town, situate wholly outside of any incorporated village, and said Wainscott Water Supply Area is more particularly bounded and described as follows:

The Wainscott Water Supply Area is the hamlet of Wainscott, in the Town of East Hampton, south of East Hampton Airport.  Such area is delineated on the north by Industrial Road, on the west by Town Line Road and the East Hampton Town line and eastern boundary of the Incorporated Village of Sagaponack, south by the Atlantic Ocean and east by Georgica Pond and Daniels Hole Road.

The Suffolk County Land and Tax Map designation for each of the parcels located within the Wainscott Water Supply Area is set forth in Exhibit A attached hereto and hereby made a part hereof, and available in the office of the Town Clerk.

Section 3.  The maximum amount proposed to be expended for the construction of the Water Improvement is $24,344,878, which is proposed to be financed by the issuance of bonds of the Town.

Section 4.  The costs of the Water Improvement, including payment of principal of and interest on said bonds as the same shall become payable, shall be borne partly by the area of the Town outside of any village and partly by the lands benefited thereby.  Such costs to be borne partly by the area of the Town outside of any village shall be paid by the assessment, levy and collection of assessments from the several lots and parcels of land in said area in annual installments in the same manner as other Town charges, and such costs to be borne partly by the lands benefited thereby shall be paid by assessment, levy and collection of assessments from the several lots and parcels of land within the Wainscott Water Supply Area which the Town Board shall determine to be especially benefited by the Water Improvement, so much upon and from each as shall be in just proportion to the amount of benefit which the Water Improvement shall confer upon the same, to pay the principal of and interest on said bonds as the same shall become due and payable.

Section 5.  The estimated cost of the Water Improvement does not exceed one-tenth of one per centum of the full valuation of the taxable real property in the area of the Town outside of any villages and, pursuant to the provision of the Town Law, the permission of the Comptroller of the State of New York is therefore not required in order to finance the cost of said Water Improvement.

Section 6.  Any funds received from the United States of America and/or the State of New York in relation to the Water Improvement shall be applied towards such cost of construction of the Water Improvement or payment of the principal and/or the interest on the Town’s obligations issued therefor, or will be budgeted as an offset to the taxes for the payment of the principal and interest on said obligations.

Section 7.  The annual cost of operation and maintenance of said Water Improvement shall be paid by a charge upon the entire area of the Town outside of any villages and shall be levied and collected in the same manner and at the same time as other Town charges.

Section 8.  Pursuant to Section 209-q of the Town Law, this Resolution of the Town is subject to permissive referendum.  The Town Clerk is hereby authorized and directed to publish or cause to be published at least once in the “East Hampton Star,” a newspaper having a general circulation in the Town and hereby designated as the official newspaper for such publication, and post on the sign board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law, a Notice in substantially the form attached hereto as Exhibit B, which sets forth the date of adoption of this Resolution and contains an abstract thereof concisely stating its purpose and effect.  The publication and posting of said Notice shall be within ten (10) days of adoption of this resolution. 

Section 9.  The Town Clerk of the Town is hereby authorized and directed to record a certified copy of this resolution, within ten (10) days of its adoption, in the office of the County Clerk of Suffolk County. 

Section 10.  The resolution adopted by the Town Board of the Town on May 21, 2018, entitled:

“Resolution of the Town of East Hampton, New York, adopted May 21, 2018, approving the construction of a water improvement within the Wainscott Water Supply Area, an area of the Town outside of any villages, which has been determined to be the benefited area, and making other determinations in connection therewith,”

is hereby revoked, rescinded and repealed.

TOWN OF EAST HAMPTON, NEW YORK

PLEASE TAKE NOTICE that on June 5, 2018, the Town Board of the Town of East Hampton, in the County of Suffolk, New York, adopted a resolution entitled:

“Resolution of the Town of East Hampton, New York, adopted June 5, 2018, approving the construction of a water improvement within the Wainscott Water Supply Area, an area of the Town outside of any villages, which has been determined to be the benefited area, and making other determinations in connection therewith,”

approving the construction of a water improvement within the Wainscott Water Supply Area, an area of the town outside of any villages, which has been determined to be the benefited area.  An abstract of said resolution, concisely stating the purpose and effect thereof, is as follows:

FIRST:  RECITING that the Town Board of the Town of East Hampton (herein called “Town Board” and “Town,” respectively), in the County of Suffolk, New York, has caused the Suffolk County Water Authority and their engineers, duly licensed by the State of New York, to prepare a general map, plan and report for the proposed construction of water improvements within an unincorporated area of the Town hereinafter described, consisting of the construction and installation of approximately 45,000 feet of water mains, including, as an where required, buildings, land or rights in land, original furnishings, equipment, and machinery and apparatus required in connection therewith, all as described in the map, plan and report prepared for the Town by the Suffolk County Water Authority, dated May, 2018 (the “Water Improvement”); all within an unincorporated area of the Town outside of any villages, which area has been determined to be the benefited area (the “Wainscott Water Supply Area”), pursuant to Article 12-C of the Town Law, which map, plan and report was duly filed in the office of the Town Clerk for public examination; RECITING that the Suffolk County Water Authority, acting as Lead Agency for the Water Improvement and the Town have complied in every respect with all applicable federal, state and local laws and regulations regarding environmental matters with respect to the Water Improvement;  RECITING that the maximum amount proposed to be expended for the construction of the Water Improvement is $24,344,878, which is proposed to be financed by the issuance of bonds of the Town; RECITING that the costs of the Water Improvement, including payment of principal of and interest on said bonds as the same shall become payable, shall be borne partly by the area of the Town outside of any village and partly by the Wainscott Water Supply Area; RECITING that such costs to be borne by the area of the Town outside of any village shall be paid by the assessment, levy and collection of assessments from the several lots and parcels of land in said area in annual installments in the same manner as other Town charges, and such costs to be borne by the lands benefited thereby shall be paid by assessment, levy and collection of assessments from the several lots and parcels of land within the Wainscott Water Supply Area which the Town Board shall determine to be especially benefited by the Water Improvement, so much upon and from each as shall be in just proportion to the amount of benefit which the Water Improvement shall confer upon the same, to pay the principal of and interest on said bonds as the same shall become due and payable; RECITING that any funds received from the United States of America and/or the State of New York in relation to the Water Improvement shall be applied towards such cost of construction of the Water Improvement or payment of the principal and/or the interest on the Town’s obligations issued therefor, or will be budgeted as an offset to the taxes for the payment of the principal and interest on said obligations; RECITING that the annual cost of operation and maintenance of said Water Improvement shall be paid by a charge upon the entire area of the Town outside of any villages and shall be levied and collected in the same manner and at the same time as other Town charges; RECITING that the Town Board determined to proceed with the construction of such Water Improvement and adopted an order on May 8, 2018, reciting a description of the improvements proposed, a description of the proposed benefited area, the maximum amount to be expended, the proposed method of financing to be employed, the fact that map, plan and report describing the same are on file in the Town Clerk’s Office for public inspection and specifying May 21, 2018 at 6:30 P.M. (Prevailing Time) as the time when, and the Town Hall, in the Town, as the place where, the Town Board would meet to consider the construction of such Water Improvement and to hear all persons interested in the subject thereof concerning the same, and for such other action on the part of the Town in relation thereto as may be required by law; RECITING that certified copies of such order were duly published and posted pursuant to the provisions of Article 12-C of the Town Law; and RECITING, that a public hearing in the matter of the construction of the proposed Water Improvement was duly held by the Town Board, at which all interested persons desiring to be heard were heard, including those in favor of, and those opposed to, the construction of said Water Improvement; and

SECOND:  DETERMINING that (a) the notice of public hearing was published and posted as required by law, and is otherwise sufficient, (b)  it is in the public interest to construct the Water Improvement within the Wainscott Water Supply Area, at the estimated maximum cost of $24,344,878 and (c)  all the property in the proposed Wainscott Water Supply Area is benefited by the Water Improvement and all the property benefited by the Water Improvement is included in the proposed Wainscott Water Supply Area; APPROVING the construction of the Water Improvement within the Wainscott Water Supply Area; AUTHORIZING the Water Improvements to be constructed within the Wainscott Water Supply Area, in the Town, situate wholly outside of any incorporated village; and DETERMINING that said Wainscott Water Supply Area is more particularly bounded and described as follows:

The Wainscott Water Supply Area is the hamlet of Wainscott, in the Town of East Hampton, south of East Hampton Airport.  Such area is delineated on the north by Industrial Road, on the west by Town Line Road and the East Hampton Town line and eastern boundary of the Incorporated Village of Sagaponack, south by the Atlantic Ocean and east by Georgica Pond and Daniels Hole Road.

The Suffolk County Land and Tax Map designation for each of the parcels located within the Wainscott Water Supply Area is attached to the Resolution and available in the office of the Town Clerk.

THIRD:  DETERMINING that the maximum amount proposed to be expended for the construction of the Water Improvement is $24,344,878, which is proposed to be financed by the issuance of bonds of the Town;

FOURTH:  DETERMINING that the costs of the Water Improvement, including payment of principal of and interest on said bonds as the same shall become payable, shall be borne partly by the area of the Town outside of any village and partly by the lands benefited thereby; DETERMINING that such costs to be borne by the area of the Town outside of any village shall be paid by the assessment, levy and collection of assessments from the several lots and parcels of land in said area in annual installments in the same manner as other Town charges, and such costs to be borne by the lands benefited thereby shall be paid by assessment, levy and collection of assessments from the several lots and parcels of land within the Wainscott Water Supply Area which the Town Board shall determine to be especially benefited by the Water Improvement, so much upon and from each as shall be in just proportion to the amount of benefit which the Water Improvement shall confer upon the same, to pay the principal of and interest on said bonds as the same shall become due and payable; and

FIFTH:  DETERMINING that the estimated cost of the Water Improvement does not exceed one-tenth of one per centum of the full valuation of the taxable real property in the area of the Town outside of any villages, and, pursuant to the provisions of said Town Law, the permission of the Comptroller of the State of New York is therefore not required in order to finance the cost of said Water Improvement, in the Town; and

SIXTH: DETERMINING that any funds received from the United States of America and/or the State of New York in relation to the Water Improvement shall be applied towards such cost of construction of the Water Improvement or payment of the principal and/or the interest on the Town’s obligations issued therefor, or will be budgeted as an offset to the taxes for the payment of the principal and interest on said obligations; and

SEVENTH:  DETERMINING that the annual cost of operation and maintenance of said Water Improvement shall be paid by a charge upon the entire area of the Town outside of any villages and shall be levied and collected in the same manner and at the same time as other Town charges; and

EIGHTH:  DETERMINING that this resolution is subject to permissive referendum; and AUTHORIZING AND DIRECTING the Town Clerk to publish or cause to be published a notice containing an abstract of the resolution within ten (10) days after adoption of said resolution, at least once in the “East Hampton Star” a newspaper having a general circulation in the Town and designated as the official newspaper for such publication, and posted on the sign board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law;

NINTH:  AUTHORIZING AND DIRECTING the Town Clerk of the Town to record a certified copy of this resolution, within ten (10) days of the date hereof, in the office of the County Clerk of Suffolk County. 

TENTH:  DETERMINING that the resolution adopted by the Town Board of the Town on May 21, 2018, approving the construction of a water improvement within the Wainscott Water Supply Area, is rescinded, revoked and repealed.

WHEREAS, James Kommer is employed by the Town of East Hampton as a provisionally appointed Environmental Analyst in the Natural Resources Department pursuant to Resolution 2017-1317, and

 

WHEREAS, the Town has decided to terminate Mr. Kommer's provisional appointment in accordance with applicable Civil Service law and rules, and, now, therefore be it

 

RESOLVED, James Kommer is placed on paid administrative leave from June 1, 2018 through June 5, 2018 and his employment with the Town of East Hampton is hereby terminated effective June 6, 2018.
