Authorize Supervisor to Sign Covenants and Restrictions for Suffolk County Department of Health Services for East Hampton Storage Corp.

 

WHEREAS, by Resolution 2013-1324, amended by Resolution 2013-1368, the Town Board authorized the assignment of a lease for a premises at the Industrial Park at the East Hampton Airport known as 75 & 77 Industrial Road, East Hampton (shown on the Suffolk County Tax Map as SCTM #0300-192.00-03.00-054 & p/o 43.1) to East Hampton Storage Corp. (d/b/a Twin Forks Mini Storage) ; and

 

WHEREAS, the aforementioned site is not needed for aviation purposes and is not necessary for the efficient and proper operation of the airport or landing field, and the Town does not foresee the site being needed for such purposes during the term of the lease or any renewals provided for in the lease; and

 

WHEREAS, East Hampton Storage Corp. who utilizes the site as part of their moving and storage operation, desires to construct an additional 78,960 sq. ft. commercial structure on their leased site, and to convert an existing 27,440 sq. ft. commercial building to be partially occupied as a mini-storage facility and as a bulk storage with bulk storage office facility to be used for the storage of goods only not to be utilized by an employee or any person except for the placement and removal of stored goods; and

 

WHEREAS, as a condition of approval by the Suffolk County Department of Health Services, certain covenants and restrictions are required related to the proposed uses, to represent that the areas designated as mini-storage space shall not contain a water supply or sanitary system and the areas designated for mini-storage shall be heated only to the extent necessary for the preservation of goods stored on the property and the maximum permissible daily sewage discharge for the site shall not exceed 1,380 gpd; and

 

WHEREAS, the Covenants and Restrictions setting forth the limitations on the use of the structures upon the premises are requested to be submitted to the County by the Town as the property owner, as the Applicant, East Hampton Storage Corp., is a tenant at the site, now therefore be it

 

RESOLVED, that the Supervisor is authorized to sign a Declaration of Covenants and Restrictions, in a form to be approved by the Town Attorney, and acceptable to the Suffolk County Department of Health Services, restrictions on the use of the proposed improvements on the site leased by East Hampton Storage Corp., with regard to the Applicant’s application for the approval of providing for construction of a 78,960 sq. ft. commercial structure and the conversion of an existing 27,440 sq. ft. commercial building to be partially occupied as a mini-storage facility and as a bulk storage with bulk storage office upon the premises located at the Industrial Park at the East Hampton Airport and known as 75 & 77 Industrial Road, East Hampton (shown on the Suffolk County Tax Map as SCTM #0300-192.00-03.00-054 & p/o 43.1).
